Appellate Practice

Shumaker, Loop & Kendrick, LLP recognizes that effective representation of our clients in appellate matters requires experienced appellate specialists. Our Appellate Practice Group is available to assist in matters that involve, or are likely to involve, an appeal. This practice group includes experienced appellate practitioners who have represented clients before the United States Supreme Court and a wealth of state and federal courts throughout the country, including Florida, North Carolina, and Ohio. Members of the Appellate Practice Group typically work with other Shumaker Loop & Kendrick lawyers who contribute high levels of proficiency in a particular area of law to the appellate representation.

Most often our Appellate Practice Group lawyers act as lead appellate counsel in matters that the firm handled in the trial courts, although Shumaker Loop & Kendrick also handles appeals of cases tried by other law firms, or acts as co-counsel with other lawyers for appellate purposes. Shumaker Loop & Kendrick recognizes the advantages of having an appellate lawyer actively involved in the trial court to assist with framing the legal theories and preserving points for an eventual appeal, and recommends the early involvement of the Appellate Practice Group in any significant litigation. We also serve as counsel of record for organizations wishing to participate in appellate proceedings as an amicus curiae, or “friend of the court.”

DUANE A. DAIKER is a partner in the appellate and commercial litigation practice groups in the Tampa, Florida office of Shumaker, Loop & Kendrick, LLP. His principal areas of practice are appellate representation and commercial litigation. Mr. Daiker is Board Certified by the Florida Bar as an Appellate Practice Specialist.

Mr. Daiker represents individual and corporate clients in a variety of appellate and commercial litigation matters. Mr. Daiker has extensive experience in appellate practice in state and federal court. He also represents sureties in connection with payment, performance, and fiduciary bonds.

Mr. Daiker has served as an Adjunct Professor at St. Petersburg College, teaching classes in legal research and writing, since 2000.

While at the University of Florida, Mr. Daiker was the Editor-in-Chief of the Florida Law Review and a member of the Order of the Coif.

Mr. Daiker is AV® Peer Review Rated by Martindale-Hubbell. He is also certified by the Supreme Court of Florida as an Arbitrator, and regularly arbitrates disputes for the Better Business Bureau and the Florida Bar Association.

Mr. Daiker has been recognized as a Florida Rising Star by Super Lawyers® magazine.

Mr. Daiker is admitted to practice in all Florida state courts. He is also admitted to practice in the U.S. District Courts for the Northern, Middle and Southern Districts of Florida, the 10th and 11th Circuit Courts of Appeals, and the United States Supreme Court.
